The 2009 session of the Virginia legislature was devoted to fiscal issues and so 2010 would be the first year when it is likely that the state would consider carbon dioxide storage legislation. At this juncture the state believes its current unitization laws are sufficient for the aggregation of rights necessary for carbon storage. As to the issue of pore space, the state is researching the issue and could conceivably have recommendations for the Governor’s consideration for legislation in 2010. Otherwise, it appears Virginia is likely to await the EPA rule development process under the Safe Drinking Water Act so as to conform their system to the EPA system.
