The state of Illinois has not passed any legislation dealing specifically with the issues of pore space ownership, eminent domain, or long term liability. However, in August of 2009, the state legislature passed HB 3854 which established the Carbon Capture and Storage Legislative Commission. The CCS Legislative Commission is tasked with making a report to the Illinois General Assembly by December 31, 2010 concerning specified legislation on CCS. HB 3854 also amended the Illinois Power Agency Act to allow the agency to acquire by eminent domain permanent easements for the distribution, transportation, and storage of CO2.
