This report summarizes development of laws and regulations for the non-EOR-related geologic storage of carbon in states and Canadian provinces.

The report focuses on the transportation of carbon dioxide (CO2) through pipelines from a “source” to a geologic ”sink,” the possibility of a federal mandate requiring capture and storage of CO2, and provides an overview of carbon capture drivers, the geologic means of storing CO2.

IOGCC CCGS Task Force Phase II Biennial Review of the Legal and Regulatory Environment for the Storage of Carbon Dioxide in Geologic Structures, IOGCC Task Force on Carbon Capture and Geologic Sequestration, September 2010.  The first in a continuing series of reports by the IOGCC, this report reviews state and provincial activity in implementing legal and regulatory frameworks for the storage of CO2 in geologic structures and updates the IOGCC Model Statute and Model Rules and Regulations for the storage of CO2 in geologic structures.

CO2 Storage: A legal and Regulatory Guide for States (2007). In December 2002, the IOGCC established the IOGCC Carbon Capture and Geologic Storage (CCGS) Task Force. Its membership included representatives from IOGCC member states and international affiliate provinces, state and provincial oil and gas agencies, the U.S. Department of Energy (DOE), DOE-sponsored Regional Carbon Sequestration Partnerships, the Association of American State Geologists and independent experts.

In 2006, the Task Force began work on Phase II to start development of this detailed guidance document. The most critical components of the full report are a model CO2 storage statute, a set of model rules and regulations governing the storage of CO2 in geologic media and an explanation of those regulatory components. Also included is a report addressing the ownership and righ of injection of CO2 into the subsurface.

CCGS Task Force Phase I Final Report (2005). This final Phase I report of the IOGCC Geological CO2 Sequestration Task Force, published on January 24, 2005, contains (1) an assessment of the current regulatory framework applicable to carbon capture and geologic storage and (2) recommended regulatory guidelines and guidance documents for the states and provinces.
